Lawsuit filed against U.S. Marshal, SAPD officer who shot, killed unarmed suspect while serving warrant
The widow and daughter of a man who was shot and killed by an SAPD officer and a U.S. Marshal attempting to serve a warrant have sued those law enforcement officers as well as the City of San Antonio.
The federal lawsuit, filed Jan. 13 on behalf of Randall Glen Goodale Jr.’s widow and minor daughter against the city, Deputy U.S. Marshal Mark Seguin and SAPD officer Nathan Bundy claims the officers denied Goodale of his constitutional rights under the Fourth, Fifth and 14th Amendments and seeks damages in excess of $75,000.
The lawsuit blames “policies and customs” of the City of San Antonio that “enabled its agents and employees to act with deliberate indifference to (Goodale’s) constitutional rights, as well as the improper hiring, inadequate training and supervision of Officer Bundy…”
On Jan. 13, 2020, Randall Goodale, 45, was shot by officers and killed as they were attempting to arrest him at a home in the 4400 block of Stetson View on a federal felony warrant for felon in possession of a handgun.
The lawsuit claims that Goodale was unarmed as he sat in a vehicle in a friend’s driveway and was shot “less than 20 seconds after officers blocked the driveway, exited their vehicles, and drew their weapons.”
On the day of the shooting, SAPD Chief William McManus told media that officers opened fire after Goodale “started ramming into occupied police vehicles.”
Video surveillance footage later obtained by the KSAT 12 Defenders appears to contradict the San Antonio police chief’s claims about what led up to the moment law enforcement officers opened fire on the suspect.
The lawsuit mentions the discrepancies and blames the city for “immediately adopting the officer’s version of events in an attempt to justify its officer’s use of deadly force to the public rather than determine the truth of what occurred.”
Goodale’s widow and daughter are seeking damages in excess of $75,000 for pain and suffering as well as funeral and burial expenses and are asking for a jury to determine the proper amount.

Man, woman, in critical condition after being shot through door of apartment, police say
A man and a woman are hospitalized following a shooting at a Northeast Side apartment complex late Monday night, San Antonio police said.
The incident occurred around 9:45 p.m. at an apartment complex in the 3600 block of Binz-Engleman Road, not far from Fort Sam Houston and Interstate 35.
According to police, a female suspect was arguing with the couple in the doorway of the apartment shortly before the shooting. That’s when, police say, the man closed the door and the woman fired a gunshot through the door, striking one of the victims in the neck and the other in the back. The suspect fled the scene.
The man and woman were taken by EMS to Brooke Army Medical Center, where they are both listed in critical condition.
The San Antonio Police Department, the San Antonio Fire Department and EMS all answered the call.
So far, no arrests have been made. It is unclear what the argument was about. The investigation into the shooting is ongoing, police said.
Investigation underway after homeless man is shot in hip, police say
San Antonio police are investigating after a man was shot in the hip early Tuesday morning.
Officers were called just before 2:30 a.m. to the 100 block of Alta Sita Street, not far from West Commerce Street and South General McMullen Drive after receiving word of a shooting.
According to police, a homeless man was shot once behind an abandoned business. Police said the victim didn’t provide much information and couldn’t explain how or why he was shot.
The victim was taken by EMS to University Hospital, where he is listed in stable condition.
The San Antonio Police Department, the San Antonio Fire Department and EMS all answered the call.
So far, no arrests have been made in the case. The investigation is ongoing, police said.
SAPD: Victim uncooperative after being found shot in backside
A man who was shot Monday evening was uncooperative with officers and was taken to an area hospital for his wound, San Antonio police said.
Officers were called around 11:40 p.m. to the 450 block of Hot Wells Boulevard, not far from South New Braunfels Avenue and Interstate 37 after receiving word of a person wounded.
According to police, officers arrived to find the man with a gunshot wound to his backside. He was taken by EMS to Brooke Army Medical Center for his injury.
Officials said the victim was not very cooperative, so they don’t have much to go on. The victim did say the shooting happened while he was on a bike and that a vehicle pulled up to him and some words were exchanged. A bike however, was not found.
The San Antonio Police Department, the San Antonio Fire Department and EMS all answered the call. A witness told police they heard the gunshot, but didn’t witness it.
The investigation is ongoing, police said.
COVID testing results slow for Community Labs as demand skyrockets
Community Labs has partnered with Metro Health to offer eight walk-in mass, testing sites.

Several people being tested Monday were told they should expect results between 24 to 72 hours.
It’s a combination of issues, president of Community Labs Sal Webber told us last week a delay with shipping caused results to be backlogged.
“There were two small chemical components that were not delivered by FedEx,” Webber said on January 11th.
Now, COVID is leading to staffing shortages for Community Labs.
“The staffing kind of came in on top of the hole that we had from the logistics issue. And so it’s made it very hard to catch up,” Webber said.
He explained they tried to catch up this weekend, their lab working 24/7, but they’re not there yet.
His hope is the 72 hour turnaround time is temporary.
“If we can maintain the pace with the staff we have and nobody else goes out, then you know that should be a very temporary situation,” Webber said.
Meanwhile, their testing sites have a constant stream of people.
Wonderland of the Americas tested almost 2,000 people Friday. Testing proctors tell us Monday was slower but it’s still busy and has been for the last year.
Jose and Teresa Flores came because she’s been under the weather.
“We came out because she had symptoms a couple of days ago. She had like a scratchy throat, and I guess she had a fever, right?” Jose said.
“A little bit, 99.5,” Teresa added.
Webber can’t promise when they’ll be back to their normal turnaround times, just that they’re working as fast as they can with their current jump in positivity rate.
“Nobody thought you were going to see a 50 percent of anyone population, 50 percent. We thought we might be able to get to, you know, 10 or 12 percent again,” Webber said.
When tests come back positive, they need to be retested, which is more labor-intensive.
Webber believes their lab may have seen a peak last Tuesday or Wednesday and that the positivity rate could be dropping, but they won’t know for sure until they get through this last backlog.
Booker’s season-high 48 helps Suns rally past Spurs 121-107
Devin Booker had a season-high 48 points and the Phoenix Suns dominated the fourth quarter to defeat the San Antonio Spurs 121-107 Monday night for their fourth straight victory.
Chris Paul added 15 points and 12 assists as Phoenix won its sixth straight on the road and fifth consecutive in San Antonio.
“It’s the benefit of having Chris Paul,” Suns coach Monty Williams said. “Chris can read the game. Chris, when he reads it, he’ll just run certain sets that we have to get Book the ball in certain spots. When a guy is rolling like that, you just kind of let him have the ball and space the floor properly.”
Spurs center Jakob Poeltl had 23 points and 14 rebounds, and Dejounte Murray added 18 points.
Phoenix arrived in San Antonio after a 135-108 victory in Detroit on Sunday. The Suns started sluggishly against the Spurs, but Booker scored 18 points in the opening quarter to keep the game close.
“I just respect (the Spurs) to the highest level,” Booker said. “I understand the level that they compete at and especially the level that they play at here in San Antonio. I just wanted to be aggressive from the start.”
Booker was 18 for 33 from the field and 5 for 13 on 3-pointers in eclipsing his previous high of 38 points, which he collected twice.
“Shoot, it’s been like that for a while,” Paul said of Booker’s hot start. “I think it’s probably because we’ve got a team that’s so supportive and we enjoy seeing each other do well. So, when we he gets it going like that, we try to feed him and then we still make the right play. For us, it’s all about ultimately winning the game.”
Phoenix was without injured starter Deandre Ayton, but reserve center Bismack Biyombo responded with 17 points and 14 rebounds.
“We needed some rebounding,” Williams said. “They were kicking our butt. Now Jalen (Smith) can rebound, but they had some guys down there that can move you around a little bit. I thought Bis would give us a bit more girth down with Poeltl and Jock Landale.”
Cameron Johnson was also key, scoring four of his eight points in a crucial stretch midway through the final quarter.
Johnson had a steal, which led to a contested layup that gave Phoenix a 103-98 lead with 7:44 remaining. Johnson made two free throws a minute earlier to put the Suns up 99-98.
The Spurs had three turnovers in a two-minute span beginning with Johnson’s steal as the Suns took command late.
Phoenix outscored San Antonio 34-16 in the fourth quarter.
“They’re a very good team,” Spurs forward Keldon Johnson said. “They were in the championship last year. We kind of shot ourselves in the foot a couple of times with some bad turnovers.”
The Spurs had their regular starting lineup together for the first time since Dec. 23. A return to familiarity sparked a fast start, as San Antonio took a 28-20 lead with every starter scoring at least three points.
The Spurs starters all finished in double figures, accounting for 84 points.

The Spurs have seven players averaging double figures this season.
